ok well here it goes.
i had my friend who works at mazda of cool spring change my clutch out for $180, the clutch is a used exedy stage 1 with less than 5k on it and i paid $100 for it and i got a new TOB from nissan. he changed it out on December 13th and by that thursday the 18th 5 days later the clutch went out. what happened was when he changed the clutch i think he put the throw out bearing on back wards cause when we went to bleed the clutch while the car was started there was a loud ass noise and a bunch of smoke came out from under the hood.
so it didn't bother me that much cause i just thought that the TOB was just to weak cause of the pressure plate being stiff. the noise stops after about 6 miles and the on Thursday(the 18th) that noise came back and i told him about it and he said that we would change the TOB that Saturday. well i leave work and head to my friends house and it has gotten worse. and it is having a problem going from first to second then i said screw it and stopped using the clutch until i needed to. i get to a gas station to get gas and i start the car up and try to put it into first and there is a wall, so i start it with first in and it starts to move with the clutch in, luckily i get to my house. i had to miss 2 days of work because of this and will have to get my car towed back up to cool springs to have him fix it.


so my question is. do i get him to buy me a new clutch cause he did it wrong or am i pretty much SOL?

any help?

daniel- it was a side job but he did it at his work cause i work there also

boosted s14- we will find out when we pull the tranny off.

Ventolin- but still, i paid him to do a job and it possible that he didn't do it right. i will know when i get back into town

side jobs arent gonna have anything to do with the company being responsible

could you argue there was a verbal contract?

i know there are such things and they do hold up in court for example...

But this would be a small claim.. so probably not even worth it

Used parts + friends working on cars for you= recipe for failure

more than likely your gonna have to get it fixed.. i would have a professional do it.. what if he agrees to fix it and messes up something again?

This is something you need to take up with him. If he denies any wrongdoing or any assistance, then your best chance is to go to small claims court over it. Unfortunately, convincing a jury that you were in the wrong will be tough considering it was a side job done with used parts.

dude, you said he is your friend. him changing your clutch for that price was an obvous favor. But he fucked up on it (well possible fucked up, you wont know for sure till the tranne is down again). Anyways, you fucked up as well. You had a friend of yours do something important for you.
He did you a favor, so do him a favor and dont be a dick to him and make him pay something. Either have him give you your money back for installing it and then go get a new clutch somewhere and have someone else put it in. Or get yourself a new clutch and see if he will do this job for free.

send a pm to seNATer and tell him I told you to ask him. Ask him what clutch he is running in his fast back. It is a fucking sex ass feeling fucking clutch. Soft as hell petal but strong as fuck clamp force. It feels so geat and clamps soo good its just crazy! Its actually a stage 2 and its some off brand ebay clutch at that but no lie, this thing is badass. Just ask him whats up.

i have nothing to do with the company its all with him.

a lot depends on if he actually put the TOB on backwards, if he did i would like him to fix it, if it was just a mechanical failure i'm gonna have to work on it myself


i know what he did was a favor but i have a feeling im gonna have to buy a autozone(SHIT) clutch
he said befor i left that he was gonna change the TOB but it broke befor he could do it

and im not wanting to go to court over this

Then you need to talk to your friend about it. Theres nothing we can tell you, its between you and him. If you're looking for vindication, then yes, I believe he owes it to you to help with the next install.
